A Marion man out on bond on child sex charges from earlier this year was again indicted by a Smyth County grand jury on a similar charge in late September.

According to court documents, 45-year-old Bert Tony Cooper was indicted in March on three counts of forcible sodomy and one count each of rape, object sexual penetration and aggravated sexual battery.

According to a criminal complaint filed in Smyth County Circuit Court, the juvenile girl told police that Cooper had been having sex with her against her will for three years. A separate document noted that the abuse began when the girl was 12 years old. Records state that those offenses took place in Cooper’s home.

Cooper was released on a $50,000 secured bond in mid-April, according to court records.

In July, Cooper was arrested again on charges of taking indecent liberties with a child and sexual battery.

According to that criminal complaint, the mother of a second juvenile girl reported to police that she had found inappropriate messages from Cooper on her daughter’s cell phone.

 During an interview with police, the second girl told investigators she had been alone with Cooper at his residence, during which time he put his hands down her pants and asked to have sex with her. The girl told police that she told Cooper “no” and tried to walk away, but he pulled her back toward him.

Cooper was arrested on the second set of charges July 15 and has been held at the regional jail in Abingdon without bond. If convicted, Cooper could face up to 10 years in prison on his most recent charges.

He is scheduled to appear in Smyth County Circuit Court on the initial charges Oct. 24. A trial date for the July charges has not yet been scheduled.

A Saltville man was also indicted on child sex-related charges during the September term.

According to court documents, 53-year-old Christopher Eugene Rose was arrested in late May, after a 10-year-old Marion girl told police he had tried to “show” her how to have sex.

The criminal complaint states that Rose encouraged the child to look at pornographic material on his cell phone while at her home, telling her that she was the age at which she should be experimenting with sex. The complaint goes on to say that Rose offered to show her how to have sex several times.

Rose was charged with taking indecent liberties with a child. Free on a $1,500 secured bond, he is scheduled for trial Nov. 28.

Others indicted during the September grand jury session include 27-year-old Matthew Glenn Cleary, of Glade Spring. Cleary was indicted on charges of malicious wounding, possession of a sawed-off shotgun, possession of a firearm by a convicted felon and possession of methamphetamine.

Timothy Walderman Gates, 40, of Saltville, was indicted on two counts abuse or neglect of a child.

Shane Robert Testerman, 20, of Rural Retreat, was indicted on charges of grand larceny, credit card theft and eluding police.

James Alden Nunley Jr., 37, of Marion, was indicted on statutory burglary, grand larceny and possession of methamphetamine charges.

Matthew Thomas Glosson, 28, of Marion, was indicted on charges of possession of methamphetamine, possession of methamphetamine with intent to distribute, possession of a firearm by a convicted felon and eluding police.

Michael Dwayne Ferley, 48, of Saltville, was indicted on two counts possession of methamphetamine and one count drug possession with intent to distribute.

Matthew Michael Baker, 27, of Pensacola, Florida, was indicted on a possession of methamphetamine with intent to distribute charge.

Glenda Gail Keller, 41, of Saltville, was indicted on charges of possession of marijuana with intent to distribute and possession of methamphetamine.

James Anthony Boardwine, 37, of Saltville, was indicted on charges of possession of marijuana with intent to distribute, possession of methamphetamine and possession of a firearm while in possession of a controlled substance.

Tomeka Dawn Brooks, 26, of Sugar Grove, was indicted on possession of methamphetamine and possession of methamphetamine with intent to distribute.

Sara Jane Hardin, 32, of Adwolfe, was indicted on possession of methamphetamine, perjury and shoplifting charges.

Jonathan Matthew Baker, 32, of Sugar Grove, was indicted on possession of methamphetamine and eluding police charges.

Steven Craig Wynegar, 52, of Meadowview, was indicted on possession of methamphetamine and possession of a firearm while in possession of methamphetamine charges.

Michael Wayne Vacha, 60, of Marion, was indicted on possession of methamphetamine and possession of a firearm while in possession of methamphetamine charges.

Sterling Cain Moon, 24, of Madison Heights, was indicted on possession of heroin and possession of a firearm while in possession of heroin charges.

Raymond Joseph Langley Jr., 51, of Chilhowie, was indicted on distributing oxycodone and possession of a firearm by a convicted felon charges.

Patricia Lynn Langley, 42, of Chilhowie, was indicted on possession of oxycodone and possession of a firearm while in possession of oxycodone charges.

Billy Joe Wray, of Chilhowie, was indicted on two counts possession of methamphetamine and one count possession of hydrocodone.

Allyson B. Firebaugh, 21, of Marion, was indicted on a possession of methamphetamine charge.

Andrew Frank Ellis, 29, of Marion, was indicted on a possession of methamphetamine charge.

Karen Patrice Pruitt, 52, of Marion, was indicted on a possession of methamphetamine charge.

Erika Nicole White, 31, of Senecca, South Carolina, was indicted on a possession of methamphetamine charge.

Nathan Lyle Surber, 36, of Saltville, was indicted on a possession of methamphetamine charge.

James Frederick Crawley, 36, of Marion, was indicted on a possession of methamphetamine charge.
