Police have seized a Rural Retreat man’s cell phone and charged him with a misdemeanor after he was accused of videoing a man in the shower at the Wytheville Community Center.
Kevin Ryan Cole, 25, was arrested on March 1 and charged with filming a nude person without consent, a class 1 misdemeanor punishable by up to a year in jail and a fine.
According to a search warrant application for Cole’s cell phone, the Wytheville Police Department started investigating Cole after a man showering at the community center told the staff that someone was taking pictures of him.
“Cole admitted to your affiant to taking a video of the male in the shower,” Officer N. Stroupe wrote in the search warrant. “He also admitted this was the second time today of taking images on his phone of someone in the shower at the rec center.”
Police said Cole also admitted to capturing similar images at Wytheville gas stations.
“Cole admitted to deleting the images from his phone,” Stroupe wrote. “Also admitted that he has looked at images of underage juveniles online.”
Police got the warrant to look for photographs and videos, social media accounts and for Cole’s internet search history.
Arraigned on March 4 and given a court-appointed attorney, Cole is being held without bond in the New River Valley Regional Jail in Dublin.
“Based upon the accused’s written statements, there is strong evidence to suggest a similar crime would be committed if release,” a magistrate wrote when deciding whether to grant Cole bond.
Employed at Wendy’s for three weeks at the time of his arrest, Cole has no criminal history, according to court records.
He will have a bond hearing on Monday in Wythe County General District Court.
