A Marion man charged with involuntary manslaughter in the January hit-and-run accident that claimed the life of a Chilhowie woman will now stand trial in Smyth County Circuit Court.

Joseph Howard Kestner, 31, was indicted on charges of involuntary manslaughter and failure to stop at the scene of an accident during a June 25 grand jury session.

The crash happened January 6 when a gold 1993 Honda Accord ran off the road and crashed through 87-year-old Margaret Poe’s bedroom, killing her.  The driver fled the scene, leaving the Honda behind, protruding through the opposite end of the home, where it came to a rest after crashing through four walls.

Virginia State Police Trooper K.S. Chapman said in January that Kestner initially admitted to being inside the vehicle when it crashed, but denied being the driver, telling investigators that the driver had blacked out before the crash. Days later, Kestner admitted to being the only person inside the vehicle, Chapman said.

Kestner has been held without bond at the regional jail in Abingdon since his January 10 arrest. He is scheduled for trial in circuit court Sept. 4.

Also indicted during the June grand jury session was a Marion man accused of assaulting a man and holding a knife to his throat as he drove down the road.

According to a criminal complaint filed in the circuit court, 39-year-old Wendell Gentry Bise Jr. jumped into the man’s vehicle as the man was pulling out of a driveway with Bise’s wife inside. The man told police he was giving her a ride to another residence.

According to the complaint, Bise put a knife to the man’s throat and grabbed the wheel as he was driving. The man also reported that Bise had struck him in the head with a hammer and threw the man’s phone out the window.

A knife and a hammer were found at the scene, but the investigating officer noted that no visible injuries were observed.

Bise is charged with carjacking, abduction and attempted malicious wounding. He also has a Sept. 4 trial date.

Others indicted during the June session include 39-year-old Eric Wayne Sexton, of Marion. Sexton was indicted on charges of malicious wounding and threatening to burn a home.

Timoteo Peralta, 35, of Chilhowie, was indicted on a charge of sexual battery of a child under 13 years of age.

Shaina Natasha Schibinger, 22, of Marion, was indicted on a charge of abuse or neglect of a child.

Timothy Allen Griffey, 48, of Marion, was indicted on two counts assault against law enforcement officers and one count malicious wounding.

Tonya Ann Kidd, 43, of Sugar Grove, was indicted on two counts grand larceny, one count statutory burglary and one count larceny with intent to sell or distribute.

Susan Marie Eastridge, 42, of Atkins, was indicted on two counts statutory burglary and one count grand larceny.

Nathan Allen Baumgardner, 18, of Marion, was indicted on charges of statutory burglary and grand larceny.

Brandon Holdaway, 18, of Saltville, was indicted on charges of statutory burglary and grand larceny.

Amy Elaina Mitchell, 38, of Saltville, was indicted on four counts credit card fraud.

Aaron Lee St. Clair, 36, of Marion, was indicted on two counts credit card theft and one count receiving goods obtained by fraud.

Bobby Junior Haga, 51, of Atkins, was indicted on a grand larceny charge.

James Junior Perkins, 35, of Marion, was indicted on a grand larceny charge.

Robert Dewayne Montgomery, 36, of Bristol, Tenn., was indicted on a grand larceny charge.

Jerada Henderson, 37, of Locust Grove, Ga., was indicted on charges of possession of more than 100 grams of methamphetamine, transporting methamphetamine into Virginia and possession of a firearm by a convicted felon.

Rusty Ray Blevins, 38, of Marion, was indicted on two counts possession of methamphetamine, one count possession of marijuana with intent to distribute and one count possession of a firearm by a convicted felon.

Barry Joseph Hunt, 54, of Saltville, was indicted on charges of possession of methamphetamine, possession of a firearm while in possession of methamphetamine and possession of a firearm by a convicted felon.

Shannon Lee Campbell, 41, of Marion, was indicted on charges of possession of methamphetamine, possession of a firearm while in possession of methamphetamine and possession of a firearm by a convicted felon.

Christopher Lee Burchett, 37, of Marion, was indicted on two counts possession of methamphetamine and one count possession of a firearm while in possession of methamphetamine.

Tyler Wayne Testerman, 27, of Rural Retreat, was indicted on charges of possession of methamphetamine and possession of a firearm while in possession of methamphetamine.

Arville Matthew Roark, 41, of Saltville, was indicted on charges of possession of methamphetamine and possession of a firearm while in possession of methamphetamine.

Joshua Martin Hall, 38, of Bristol, Tenn., was indicted on charges of eluding police, possession of alprazolam with intent to distribute and possession of methamphetamine.

Daniel Ray Dunford, 36, of Castlewood, was indicted on charges of eluding police and possession of methamphetamine.

Jacob Charles Blevins, 28, of Marion, was indicted on a possession of methamphetamine with intent to distribute charge.

Kayla Nicole Holman, 27, of Troutdale, was indicted on a possession of methamphetamine with intent to distribute charge.

Eric Grant Billings, 56, of Marion, was indicted on a possession of methamphetamine with intent to distribute charge.

Brittany Nicole Hardy, 25, of Marion, was indicted on a possession of diazepam with intent to distribute charge.

Whitney Brook Russell, 29, of Knoxville, Tenn., was indicted on a possession of heroin charge.

Brook McKenzie Bordwine, 20, of Saltville, was indicted on two counts possession of methamphetamine.

Casey Michelle Johnson, 26, of Glade Valley, North Carolina, was indicted on a possession of methamphetamine charge.

Dylan Tyler Coley, 22, of Chilhowie, was indicted on a possession of marijuana with intent to distribute charge.

Lora Michelle Gilley, 49, of Marion, was indicted on a possession of methamphetamine charge.

Carl Henry Harris, 47, of Marion, was indicted on a possession of methamphetamine charge.

William Andrew Aker, 34, of Sugar Grove, was indicted on a possession of methamphetamine charge.

Howard Julius Parrish Sr., 46, of Marion, was indicted on a charge of operating a vehicle by a habitual offender.

Stephen Matthew Barnes, 38, of Saltville was indicted on a third-offense shoplifting charge.

William Brian Coe, 39, of Saltville, was indicted during the March grand jury session on a possession of methamphetamine charge.

Dakota Bill Hutton, 31, of Atkins, was indicted during the March grand jury session on a possession of methamphetamine charge.

Penny Marie Holston, 36, of Saltville, was indicted during the March grand jury session on a possession of methamphetamine charge.

Patrick Anthony Harris, 35, of Saltville, was indicted during the March grand jury session on a possession of methamphetamine charge.

Charles Shane Smith II, 21, of Saltville, was indicted during the March grand jury session on a possession of marijuana with intent to distribute charge.
